These Terms of Use ("Terms") govern your access to and use of this esports tournament platform ("the Platform"). The Platform is operated by Jansen & Loots Limited ("we", "us", "the Platform Operator") and provided to national esports organisations ("Organisation Partners") who run school esports competitions.
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
If you are under 18 years of age, your parent, guardian, or teacher must have consented to your use of the Platform in accordance with Section 4 of these Terms.
1. About the Platform
The Platform provides tournament management services for school esports competitions, including team registration, match scheduling, match chat rooms, score submission, standings, and school leaderboards.
The Platform is made available to Organisation Partners (e.g., national esports federations) who configure and administer their own tournaments. Each Organisation Partner operates independently on their own domain (e.g., tournament.nzesports.org.nz). Your use of the Platform is subject to these Terms and to any additional rules or policies set by your Organisation Partner.
2. Eligibility and Accounts
Age requirements
- Students aged 13 and over may create their own account on the Platform.
- Students under 13 may not create an account. Teachers may register and manage teams on their behalf without creating student accounts.
- There is no minimum age to participate in a tournament, provided the student's teacher has confirmed parental or guardian consent.
Account responsibilities
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must not share your account with others or allow others to access the Platform using your credentials.
- You must notify your Organisation Partner or the Platform Operator immediately if you suspect unauthorised access to your account.
- One account per person per organisation. You may hold separate accounts on different Organisation Partners' platforms.
3. User Roles and Responsibilities
Organisation Administrators
Organisation administrators are appointed by the Organisation Partner and are responsible for managing tournaments, approving teachers, moderating disputes, and overseeing the conduct of competitions within their organisation. Organisation administrators act on behalf of their Organisation Partner, not on behalf of the Platform Operator.
Teachers and School Staff
Teachers are responsible for:
- Registering and managing teams of students from their school
- Approving or rejecting student-initiated team registrations
- Monitoring their teams' match chat rooms for safeguarding purposes
- Ensuring compliance with their school's policies regarding student participation in extracurricular activities
Consent warranty: By registering a team or approving a student's team registration, you represent and warrant that:
- You have obtained verifiable parental or guardian consent for every student you register or approve, in accordance with your school's policies and applicable law
- You have the authority to act on behalf of your school in registering students for this competition
- All information you provide about students is accurate and provided with appropriate consent
This warranty is a material term of these Terms. If you cannot make this representation, you must not register students on the Platform.
Students
Students are responsible for:
- Providing accurate registration information
- Complying with the Acceptable Use Policy (Section 5)
- Participating in matches in good faith
- Submitting accurate scores and responding to score confirmations promptly
4. Parental and Guardian Consent
The Platform is designed for use by school students participating in supervised esports competitions. For students under 18, the following consent framework applies:
- Students aged 13-17: The student's teacher must confirm that parental or guardian consent has been obtained before the student is registered or approved to participate.
- Students under 13: Only teachers may register these students, and only by providing first names and in-game usernames. No student account is created.
The Platform Operator relies in good faith on the representations made by teachers and schools regarding parental consent. The responsibility for obtaining, verifying, and retaining evidence of parental consent rests solely with the teacher, the school, and the Organisation Partner.
5. Acceptable Use Policy
You must not use the Platform to:
Prohibited conduct
- Use abusive, threatening, discriminatory, or harassing language in match chat or any other communication on the Platform
- Bully, intimidate, or target other users based on race, ethnicity, gender, sexual orientation, disability, religion, or any other personal characteristic
- Share or request personal information (phone numbers, addresses, social media accounts) of other users through match chat
- Post or share links, URLs, or references to external websites in match chat
- Share sexually explicit, violent, or otherwise inappropriate content
- Impersonate another person, team, or school
- Deliberately provide false information (including false scores, fake team registrations, or fraudulent school affiliations)
- Cheat, exploit game bugs, or use unauthorised software during matches
- Deliberately lose matches, manipulate standings, or engage in any form of match-fixing
- Attempt to access accounts, data, or features you are not authorised to use
- Attempt to access data belonging to another organisation on the Platform
- Interfere with the operation of the Platform, including attempting to circumvent security measures
- Use the Platform for any purpose unrelated to participating in or managing esports competitions
Enforcement
Violations of this Acceptable Use Policy may result in:
- A warning from your Organisation Partner or their administrators
- Temporary suspension of your account or team
- Permanent removal from the competition
- Reporting to your school or relevant authorities where required by law
Enforcement decisions are made by your Organisation Partner's administrators. The Platform Operator may also suspend or restrict access to protect the safety of users or the integrity of the Platform.
6. Match Conduct and Competition Integrity
Score submission
Match scores must be submitted accurately and in good faith. Deliberately submitting a false score is a violation of these Terms. The opposing team must confirm or dispute the submitted score.
If a score submission is not confirmed or disputed within 24 hours of the match time, the Platform may automatically accept the submitted score. This is to prevent teams from being penalised by an opponent's failure to respond.
Defaults
Teams that fail to appear for a match (no activity within 60 minutes of match time) may have a default loss recorded against them. Accumulating four (4) defaults in a tournament will result in automatic withdrawal of the team from the competition.
Defaults recorded by an administrator as a manual loss (where the team communicated in advance) do not count toward automatic withdrawal.
Disputes
If a team disputes a submitted score, the dispute will be reviewed by an Organisation Partner administrator. The administrator's decision on the correct score is final.
Chat rooms
Match chat rooms are provided for teams to coordinate their matches (scheduling, lobby setup, and match communication). Chat rooms are monitored — teachers have read-only access to their teams' chats, and Organisation Partner administrators may join any chat room.
Chat messages are automatically deleted 48 hours after a match is completed. If misconduct is reported, a snapshot of the chat may be retained for the duration of the tournament for review purposes.
7. Intellectual Property
Our intellectual property
The Platform, including its design, code, features, and documentation, is the property of Jansen & Loots Limited. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Platform.
Your content
You retain ownership of any content you submit to the Platform (team names, chat messages, uploaded images). By submitting content, you grant Jansen & Loots Limited and your Organisation Partner a non-exclusive, royalty-free licence to use, display, and store that content for the purpose of operating the Platform and the competition.
Images uploaded in match chat are automatically deleted when the associated chat messages are deleted (48 hours after match completion). We do not retain or use uploaded images for any purpose beyond displaying them in the match chat.
8. Limitation of Liability
Platform provided as-is
The Platform is provided on an "as-is" and "as-available" basis. Jansen & Loots Limited makes no warranties or representations, express or implied, regarding the availability, reliability, accuracy, or fitness for a particular purpose of the Platform.
We do not guarantee uninterrupted access to the Platform. Service interruptions may occur due to maintenance, updates, or circumstances beyond our control.
Limitation
To the maximum extent permitted by New Zealand law, Jansen & Loots Limited shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
- Any loss or damage resulting from unauthorised access to your account where you failed to maintain the confidentiality of your credentials
- Any loss or damage resulting from the conduct of other users, including content shared in match chat rooms
- Any loss or damage resulting from decisions made by Organisation Partners or their administrators regarding competition management, score disputes, or enforcement actions
- Any loss or damage resulting from service interruptions, data loss, or technical failures
User-generated content
Jansen & Loots Limited is not responsible for content created by users, including chat messages, uploaded images, team names, or any other user-submitted information. Responsibility for moderating user conduct within a competition rests with the Organisation Partner and their administrators.
Safeguarding
While the Platform provides tools to support safeguarding (chat moderation, teacher monitoring, PII protection), the primary responsibility for the safety and wellbeing of students rests with the teachers, schools, and Organisation Partners who supervise the competitions. The Platform Operator is not a substitute for school safeguarding policies and procedures.
Exported data
Organisation Partners may export tournament data from the Platform. Once exported, that data is outside the control of the Platform and is governed solely by the Organisation Partner's own policies. Jansen & Loots Limited accepts no liability for exported data.
9. Account Suspension and Termination
By Organisation Partners
Your Organisation Partner may suspend or terminate your account at their discretion for any reason, including but not limited to violations of these Terms, the Acceptable Use Policy, or the Organisation Partner's own competition rules.
By the Platform Operator
Jansen & Loots Limited may immediately suspend or restrict access to any account where we reasonably believe:
- The account poses a safety risk to other users (particularly minors)
- The account is being used to attempt unauthorised access to the Platform or other organisations' data
- The account is being used in a manner that threatens the integrity or security of the Platform
We will notify the relevant Organisation Partner of any action taken.
Effect of termination
Upon termination of your account:
- Your access to the Platform will be revoked
- Your personal data will be handled in accordance with our Privacy Policy
- Match results and standings records may be retained in anonymised form to preserve competition integrity
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users via in-app notification and/or email prior to the changes taking effect. The "Last updated" date at the top will always reflect the current version.
Continued use of the Platform after notification of changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may request deletion of your account.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of New Zealand.
Dispute resolution
Any dispute arising out of or in connection with these Terms shall be resolved as follows:

Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation within 30 days of one party notifying the other in writing.

Mediation: If the dispute is not resolved by negotiation, the parties shall submit the dispute to mediation administered by the Arbitrators' and Mediators' Institute of New Zealand (AMINZ) in accordance with its mediation protocol.

Arbitration: If the dispute is not resolved by mediation within 60 days, it shall be referred to and finally resolved by arbitration administered by AMINZ in accordance with its arbitration rules. The arbitration shall take place in Auckland, New Zealand. The decision of the arbitrator shall be final and binding.
Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and any Data Processing Agreement between Jansen & Loots Limited and your Organisation Partner, constitute the entire agreement between you and Jansen & Loots Limited regarding your use of the Platform.
